What To Do If You Are In An Auto Accident

If you are in an accident and you are injured and the other person driving the other car involved is to blame, you can file a lawsuit with there insurance company.

The person that handles your claim when in an accident is called a claims adjuster, and that person will take a recorded statement of the facts that occurred in the accident.

For example the claims adjuster will want to know the damage of the vehicles and was anybody injured in the accident. The adjuster job is to minimize the car accidents claim so the insurance company won’t have to pay a whole lot to solve the claim.

If you suffered more than a minor injury, it would be recommended that you talk to a lawyer before making any kind of claim against their insurance company. If there is no lawyer present then you will have to handle everything yourself and answer a lot of questions that might hurt your chances of getting a claim.

Here are a few examples the claims adjuster might ask you:

· Did you suffer any injuries during the accident?

· Were your injuries so bad you had to be transported by ambulance?

· What kind of treatment did you receive and for what kind of injury?

· What were the medical providers did you receive?

· Did the doctor diagnose you with any injury and what?

· Are you still in treatment for the injury?

· Do you have any kind of past injury with the injured body part?

· When did you receive treatment for the injured body part before the accident?

· Is the pain bad?

· What were the cost of your medical bill?

It would be a lot easier to deal with the adjuster with a lawyer present; you would be entitled to answer these questions on your own. The adjuster will want you to proof documentation to support the claim you have filed.

You may be asked to sign a medical authorization form and provide medical documentation to prove you going to the hospital and prove your injuries. Also you may have to prove your loss of wages in other words your lost income from your job.

If you had to travel to a doctor or if you had a housekeeper to keep your up because you were unable to take care of your home you may be able to provide receipts and your lawyer can negotiate with the claims adjuster for a settlement.

There are many rules and some bodily injury claims having dollar amounts and some states are no fault states so a claim may not be able to be filled. Most states are “fault based” states meaning if the faulting party was partially to blame you should get a settlement and you are allowed to sue the faulty parties insurance company.

In a no fault state you file a claim on your insurance company but you must have coverage on your own policy called (PIP). You may still be entitled to sue the faulty insurance company only if there were serious injuries and or death. Always check your insurance company about what your claim policies are and check the state laws, an attorney may be able to help you with any questions regarding your policy or the states rules and what your rights are to sue an insurance company.

Remember, we have a Sarasota Attorney, A Jacksonville Attorney, A Gainesville Attorney, An Orlando Attorney, A Tampa Attorney, and A Florida Attorney just for you!

The Nightmare Of A Personal Injury

Litigation can take a very long time, cases drag on for years. While cases are pending, even where an injured person's attorney is paying all of the legal expenses associated with the litigation, the injured person has to have enough money to get by. If the injured person is unable to work, has reduced income, or has expenses associated with care or disability, it may not be possible to wait until the end of the lawsuit before obtaining funds.

It would be a good idea to see a local personal injury attorney to represent you. (Remember we have Sarasota attorneys, Orlando attorneys, Tampa attorneys, Jacksonville attorneys, Gainesville attorney, Ft Meyers attorneys; we have Florida attorneys covered!)

if you have been in a car accident in Florida and got hurt. An experienced lawyer fights for your rights and helps a whole lot, they will know how to handle and move forward with your case.

The person/people that caused the accident may try to take advantage of you, this is why it’s a good idea to hire a personal injury lawyer after an accident. They guide you through the trial and make all the details like what you can get etc. clear to you.

While the court decides how much you should be compensated for your accident you need to have a personal injury lawyer that is experienced in this field  to help you get compensation for other damages like injuries and pain or suffering and resolve the case in your favor.

The personal injury lawyer should keep you in the know of the progress on your case as personal injury cases can take quite a while to resolve. It is very important that you get compensated for your damages so get a experienced personal injury lawyer that will work hard to do things right and resolve your case.

4)   Unless the debris and/or your vehicle is creating potential for another accident don’t move it unless instructed to do so by the investigating officer.

5)   Take notes of anything said by the driver or passengers of the other vehicle as to how this accident happened.

6)  Exchange information with the drivers of the other cars involved in the accident. It’s important that you get their name, address and phone numbers. Also make sure to write down the license plate numbers of all the vehicles involved in the crash and the drivers license numbers of the drivers as swell. Exchange insurance information with them too.
